Week 1 Challenge

Plan for Family Assets and Their Future

Week 1 runs October 18–24, 2026. Entries for this challenge close October 25, 2026, at 12:01 a.m. Eastern.

CLUE 1 · Family LLC

What can a family entity agreement help a family decide about shared property?

Find “Could an Entity Help Us Keep a Vacation Home or Rental Property in the Family?”

Explore Family Limited Partnerships & Family LLCs

Open the Family Limited Partnerships & Family LLCs page

A Family Limited Liability Company (LLC) can bring suitable real estate, rental properties, or family investments under one ownership structure. Family members or their trusts own interests in the LLC, while its operating agreement sets rules for decisions, distributions, new owners, and transfers. This can help a family coordinate day-to-day management, prepare for incapacity or death, share ownership with the next generation, and reduce uncertainty about how shared assets will be handled.

An LLC can also separate certain obligations of the entity from the owners’ personal assets, but protection depends on state law, actual conduct, guarantees, and proper operation. It does not replace insurance or automatically reduce estate, gift, or income taxes. Before transferring assets, review title, loans, insurance, tax consequences, and existing trusts. Filings, appropriate records, and ongoing administration are part of keeping the structure useful.

Consider Your Goals: Which family assets would benefit from clearer management, ownership, transfer, or inheritance arrangements?

CLUE 2 · Family Limited Partnership

Which set of decisions does an FLP or Family LLC agreement establish?

Find “How Do FLPs and Family LLCs Work?” and read about the governing agreement.

Explore Asset Protection Planning

Open the Asset Protection Planning page

A Family Limited Partnership (FLP) can hold suitable family investments or real estate while distinguishing the general partner’s management role from the limited partners’ interests and rights. It may help a family centralize decisions, plan lifetime gifts, and pass economic interests to children or trusts without dividing each underlying asset. The partnership agreement can address distributions, admission of new partners, transfer restrictions, and what happens when an owner dies or wants to leave.

An FLP and an LLC have different liability and management rules, so the choice should reflect your assets and goals. General partners may face personal liability, and limited partners’ rights and exposure require review. Tax savings and valuation discounts are not automatic; retained rights, the interest transferred, and valuation evidence matter. The partnership needs a real purpose, completed asset transfers, reliable records, and consistent operation. Proposed gifts should also fit your retirement resources, existing trusts, and tax-reporting obligations.

Consider Your Goals: Could shared management and a structured transfer plan help us keep family assets coordinated across generations?

CLUE 3 · Charitable Remainder Trust (CRT)

Which goal may a Charitable Remainder Trust (CRT) help a family pursue?

Read “How Does a Charitable Remainder Trust Work?” and the introduction above it.

Explore Charitable Remainder Trusts

Open the Charitable Remainder Trust page

A Charitable Remainder Trust (CRT) may suit someone who wants to combine charitable giving with payments to themselves or other beneficiaries. It can also be considered when planning for appreciated investments or real estate, diversifying a concentrated holding, or arranging payments over retirement. Depending on its design, a CRT pays a fixed dollar amount or a percentage of assets valued each year, for life or a permitted term of years. The remaining property ultimately supports the chosen charitable beneficiaries.

Contributing assets is irrevocable, so a CRT should be weighed against your need for liquidity, family inheritance goals, and other resources. A qualifying CRT may defer tax when it sells appreciated assets, but beneficiary payments can carry taxable income and capital gains. A possible charitable deduction is based on the charitable remainder interest and is subject to limits. Sale timing, asset eligibility, payout terms, investment risk, and annual administration all affect whether the strategy is worthwhile.

Consider Your Goals: How do our income needs, appreciated assets, family inheritance goals, and charitable interests fit together?
