There are some states that do not allow an agent to make medical decisions for you. They will not recognize Health Care Proxies (Durable Power of Attorney for Health Care). Those jurisdictions want one's written instructions as to what to do if one is unable to direct medical decisions. Those written instructions are called Living Wills. Often they direct comfort care rather than extraordinary means if one is diagnosed in a terminal condition. We recommend that you have both a Health Care Proxy and a Living Will as one never knows in which jurisdiction they may be located, if needed.
